HUNGUEST HOTELS - GENERAL TERMS AND CONDITIONS OF CONTRACT

Effective from: 10 April 2025
Summary of Amendments to the GTC:

The essence of the changes is to:

  • Unequivocally state the Guests' expectation to rest without disturbance, requiring other guests to exercise similar restraint and moderation;
  • Reflect the modern model of invoicing, incorporating the use of electronic invoices in PDF format sent to an email address as a method of administration;
  • Reinforce the natural consequences of the undesirable phenomenon where a Guest fails to settle all service charges or causes damage or detriment to the hotel during their stay.

These changes entered into force on 10 April 2025, and are thus applicable to all legal declarations made on or after this date.

The scope of applicability of these General Terms and Conditions extends to the services provided by the member hotels of the Hunguest Hotels Chain (hereinafter: Hunguest Zrt. or Service Provider). Hunguest Zrt. publishes these General Terms and Conditions acting on its own behalf and on behalf of the business entities operating its member hotels, with the understanding that the hotel and related services concerning individual hotels are provided by the Service Providers specified in point 1), and all rights and obligations related thereto pertain to and encumber them respectively.

Where these General Terms and Conditions mention Hunguest Zrt., it shall be appropriately understood as referring to the Service Provider specified above for the respective hotel.

2) METHOD AND CONDITIONS FOR USING THE SERVICE:

The Service: Hunguest offers accommodation with a family atmosphere and related services, based on the principle of "relax and let relax". The Guest enters into a contract for quality recreation while respecting the moral and ethical rules of fundamental human relations, as well as generally known behavioral rules regarding health and safety.

a) Ordering the Service:

Orders must generally be submitted in writing (via internet booking platform, e-mail, etc.) to the relevant hotel. Contact details for individual hotels can be found in Hunguest Zrt. publications, the hotels' own brochures, and on the website www.hunguesthotels.hu.
The order must contain the Guest's name, address, precise dates of arrival and departure, room type, and the exact description of services (meals, programs). If different types of rooms or multiple buildings exist at the given hotel, the order must unambiguously state which building, category, and type of room the Guest's order pertains to within the concerned hotel.
The hotel shall confirm every order in writing (e-mail); only upon such confirmation does the contractual relationship come into existence. Alternatively, the hotel will inform the Guest that the order is not accepted, and no contract is formed (also considering that Hunguest Zrt. would possess a right of withdrawal within the contract).

A verbally placed booking and its verbal confirmation by the Service Provider do not constitute a contract.

The ordered service is for a specified duration. If the Guest nevertheless wishes to depart permanently before the end of the specified period and thus does not fully utilize the ordered service, the Service Provider is entitled to the full consideration for the service stipulated in the order. The Service Provider is entitled to re-sell the room vacated before the expiry date. Any extension of the service use initiated by the Guest requires the prior consent of the Service Provider. In such cases, the Service Provider may stipulate payment for the services already rendered.

Hotel rooms can always be booked with services corresponding at least to the content of the "Hunguest Hotels Basic Hotel Package," which is individually defined for each hotel.
The prices, offers, and packages published by Hunguest Hotels member hotels always include the services forming the content of the "Hunguest Hotels Basic Hotel Package".
The content of the "Hunguest Hotels Basic Hotel Package" applied by Hunguest Hotels member hotels, specific to each member hotel, is contained in Annex I of these General Terms and Conditions.

b) Intermediated Services:

The current list of intermediated services included in the basic hotel package or available at the hotel can be accessed on the Hunguest Zrt. website at the direct internet address https://www.hunguesthotels.hu/mediated_services/. The valid list of "intermediated services" is published exclusively at the aforementioned internet address.

c) Validity of Offers:

Hunguest Zrt.'s offers - with the exception of Daily Room Rates - are available to Guests only for a limited room capacity. The validity period of offers is indicated individually on each occasion. In the case of individual offers, bookings are considered final upon payment of the required advance deposit.

d) Cancellation, Modification, and Withdrawal Conditions:

The Guest undertakes to inform the relevant hotel in writing of any potential cancellation, significant modification known in advance, or any other change to the services ordered by them, prior to the commencement of the service.
For individual bookings, cancellation without penalty is possible up to 3 (three) days prior to arrival, unless the individual agreement concluded with the guest provides otherwise. The penalty for cancellation within 48 hours is 50% of the booking value; for cancellation within 24 hours or in case of a no-show, the penalty is 100% of the booking value.
For group bookings, cancellation terms are specified during the individual offer negotiation.

Hunguest Zrt. reserves the right:
i) to withdraw from fulfilling the services ordered and confirmed by the Guest by means of a written declaration sent to the Guest, no later than 30 days before the commencement of service utilization, concurrently refunding any advance payment made in cash by the Guest, or in case of advance payment via SZÉP Card, refunding to the SZÉP Card. For group bookings, different withdrawal conditions may be established during individual contracting.
ii) if the Guest fails to provide the payment guarantee requested by Hunguest Zrt. under point 3 of these GTC, or fails to provide it fully as specified, to withdraw from fulfilling the services ordered and confirmed by the Guest by means of a written declaration sent to the Guest, concurrently refunding any payment guarantee or advance payment made in cash by the Guest, or in case of advance payment via SZÉP Card, refunding to the SZÉP Card. For group bookings, different withdrawal conditions may be established during individual contracting.

e) Arrival and Departure at the Hotel:

The hotel room can be occupied from 14:00 (2:00 PM) on the day of arrival and must be vacated by 10:00 (10:00 AM) on the day of departure. If the Guest does not leave the room after 12:00 (noon) on the day of departure, the Service Provider is entitled to charge the rate for an additional night corresponding to the room type, as published on the website.

f) Guest Illness, Death:

Should the Guest become ill during the period of service utilization and be incapable of acting in their own interest, the Service Provider shall offer medical assistance. In the event of the Guest's illness/death, the Service Provider is entitled to claim cost compensation from the relative, heir, or bill-payer of the ill/deceased Guest for any potential medical and procedural costs, the value of services utilized prior to death, and any potential damages caused to equipment and furnishings in connection with the illness/death.

If the authorities order the guest into home quarantine, the Guest is obligated to pay the Service Provider the service fee related to the potential extension of the booking.

g) Refusal of Service Delivery, Termination of Service Obligation:

The Service Provider is entitled to terminate the service contract with immediate effect, thereby refusing to provide services, if:
1. the Guest exhibits conduct contrary to the Service Provider's House Rules,
2. the Guest uses the provided room, apartment, or facility improperly,
3. the Guest behaves inappropriately or rudely towards the Service Provider's employees, is under the influence of alcohol or drugs, or exhibits threatening, abusive, or other unacceptable behavior;
4. the Guest suffers from an infectious disease;
5. the contracting party ordering the service fails to fulfill their advance payment obligation specified in the contract by the stipulated date.

3) PAYMENT CONDITIONS

The cost of the ordered services can be paid by bank transfer, or on-site with cash, bank card, a card issued under the Hunguest Hotels Loyalty Card Program, and, for domestic hotels – in accordance with applicable legislation – with a Széchenyi Recreation Card (SZÉP card).

Hunguest Zrt. shall issue an invoice for the service. The Guest accepts that the primary format of the invoice is an electronic invoice in PDF format, sent to the electronic mailbox designated by the Guest (currently pursuant to Section 259(5) of Act CXXVII of 2007 on Value Added Tax).

Hunguest Zrt. reserves the right to request a payment guarantee from the Guest before the utilization of the ordered hotel service, but no later than upon the Guest's arrival at the hotel. The payment guarantee may be a pre-authorization on the Guest's bank card, settlement of the ordered service on-site upon arrival with cash or cash equivalents accepted by the hotel, or a bank transfer to the hotel's bank account in the amount equivalent to the value of the ordered service before the commencement of service utilization.
In case of payment with a SZÉP card, to ensure legitimate card use, the hotel may request advance payment for the ordered services and the presentation of the Guest's official document suitable for personal identification (identity card, driving license, or passport). The Guest is obliged to comply with the identification request. If identification cannot be completed for any reason beyond the hotel's control, the hotel may refuse to accept payment with the SZÉP card.

SZÉP cards can only be accepted for accommodation and related supplementary services if the cardholder is personally present and registered as a hotel guest.

In case of bank transfer – unless the contract concluded with the hotel or the (online) accommodation intermediary provides otherwise – the Guest is obliged to credit the cost of the ordered services to the relevant hotel's bank account before arrival. In the event of service failure for any reason, or withdrawal from the contract, the full amount of the consideration paid in advance – deposit – is refundable to the Guest, which Hunguest Zrt. shall refund within a twenty working day deadline.

Cash payment is only possible at the Reception desk.

If, through no fault of its own, the Service Provider becomes aware after the Guest's departure of further payment obligations of the Guest for which an invoice has not yet been issued (e.g., voluntarily unreported minibar consumption, inventory shortage, removal of items belonging to the Service Provider /e.g., bathrobe/), the Service Provider is entitled to issue an invoice for these item(s) within 72 hours following the Guest's departure. The Service Provider must attach documented justification supporting the legitimacy of the claimed item(s) to the invoice (e.g., statement from cleaning staff, photograph). The Guest is obliged to fulfill this payment obligation by the deadline indicated on the invoice. In the event of a claim for damages, the Service Provider shall inform the Guest in the same manner without issuing an invoice.

LATE PAYMENT

Pursuant to Act IX of 2016 on the Collection Cost Allowance, Hunguest Zrt. shall charge a flat-rate collection cost allowance for late-paid invoices from businesses and contracting authorities, equivalent to EUR 40.00 per instance, converted to Forint based on the official mid-rate exchange rate of the Hungarian National Bank valid on the day the delay commenced (hereinafter: collection cost allowance), which fact shall be stated in the 1st payment reminder. The collection cost allowance becomes due on the date of the first payment reminder; its payment does not exempt from other legal consequences of the delay (it can be enforced in addition to the amount of default interest).

In case of late payment, Hunguest Zrt. is entitled to charge default interest pursuant to the Civil Code (Ptk.), unless the contract concluded between the two parties provides otherwise.

Hunguest Zrt. applies the following order when booking the collection of debts and settling claims during legal proceedings: 1. Principal, 2. Legal procedural fees, bailiff's cost allowance, 3. Collection cost allowance, 4. Default interest, 5. Attorney's fees.

4) OUR PRICES

Prices published by Hunguest Zrt. always include the Value Added Tax (VAT) prescribed by law and valid at the time of booking. However, the prices do not include the tourist tax, which must be paid on-site at the location of the service, except for those price offers where Hunguest Zrt. specifically indicates: "the indicated prices include the tourist tax". The prices also do not include the cost of travel to and from the location, nor tour guide fees, nor services ordered separately beyond the basic service package (see Annex I).
Prices - pursuant to Section 6 of Joint Decree 4/2009 (I.30) NFGM-SZMM - are displayed at the place of service provision in a manner compliant with legislation. The Guest can also receive adequate information about the service fee at the hotel reception before the service provision commences. Information on the current pricing of the hotel can be found on the Hunguest Zrt. website (www.hunguesthotels.hu/en).

Hunguest Zrt. reserves the right to change prices and may freely alter them without prior notice.

The prices currently applied will be communicated by the hotel in the booking confirmation.

The Service Provider and the Guest agree that the date of performance of the provided service (Section 55 (1) of the VAT Act) shall be considered the last day on which the Guest factually utilized a service.

5) SPECIAL SERVICES

a) Child Discounts:

Discounts are valid exclusively for children travelling together with their parents and do not apply to student groups.

b) Board Meals:

Depending on prior arrangement with the hotel and the offer published by the hotel, board typically runs from dinner on the day of arrival to breakfast or lunch on the day of departure – potentially varying by individual hotel.

c) Programs:

The hotel provides information about program offers and their current prices at the time of booking accommodation or during the Guest's stay. Certain programs offered by Hunguest Zrt. only commence if a specified minimum number of participants is reached. The Guest must coordinate with the relevant hotel regarding programs at the time of booking. Programs are listed in the publications of individual hotels and on the website https://www.hunguesthotels.hu/en.

6) COMPLAINTS

In case of any complaints arising during the hotel service period, the Guest may raise objections in writing at the hotel reception desk up until the time of departure.
The hotel is obliged to investigate complaints and respond substantively within five working days.

7) COMPENSATION

The hotel is liable for damages caused by it in accordance with the relevant legal regulations.

If the Guest fails to make a complaint on-site, they shall not be entitled to compensation later.

The Guest is liable for all damages and detriment suffered by the Service Provider or a third party due to the fault of the Guest, their companion, or other persons under their responsibility. This liability persists even if the injured party has the right to claim compensation for their damages directly from the Service Provider.

The Guest declares that they have read and acknowledged the General Terms and Conditions and accept the House Rules as binding upon themselves.

Medicinal and beach bath entry passes to the adjacent Gyula Castle Bath and the Aquapalota, equal in number to the number of nights stayed, granting unlimited entry (the Gyula Castle Bath and Aquapalota entry pass entitles the holder to use the currently operating pools during the respective valid opening hours). Use of bathrobe. Use of the hotel's Harmónia Spa Center.
